Reservations

Reservations can be made via website, email, or telephone. To secure a reservation, a deposit of 30% of the total amount is required. Payment of the deposit constitutes full acceptance of these Terms and Conditions. Upon confirmation of payment, the client will receive a confirmation email along with the corresponding invoice.

Payments

The remaining balance must be paid prior to the start of the tour or rental. Payments may be made in cash or via bank transfer. For bank transfers, proof of payment must be provided.

Cancellations & Refunds

Refund Policy — Cancellations made with at least 48 hours notice before the start of the tour are entitled to a full 100% refund of the deposit paid, or the option to reschedule to a future available date. Less than 48 hours before the start: no refund will be possible. All cancellations must be communicated in writing via email.

Changes and Cancellations by MADBIKE — MADBIKE reserves the right to modify or cancel activities due to reasons such as adverse weather conditions, safety concerns, or external factors beyond its control. In such cases, an appropriate alternative will be offered, or a full refund will be provided. MADBIKE shall not be held responsible for any additional expenses incurred by the client (e.g., flights, accommodation, or transport).

Shuttle Service

MadBike assumes no responsibility for accidents during transport, damage to bicycles (owned or rented), or loss, damage, or theft of personal belongings.

Assumption of Risk

The client acknowledges that mountain biking involves inherent risks, including falls, physical injuries, and adverse natural conditions. By participating, the client declares that they are physically fit, voluntarily participating within their limits, and using appropriate safety equipment (helmet, knee pads, and elbow pads). MadBike shall not be held liable for any injuries, damages, or death resulting from participation.

Insurance

The tour includes a group personal accident insurance policy, with coverage and capital limits in accordance with the minimum requirements established by Portuguese law. Coverage includes accidental death, permanent disability, medical expenses, and rescue costs, within the limits of the policy. Any expenses exceeding these limits shall be the responsibility of the participant. All medical expenses and corresponding hospital invoices must be submitted as soon as possible for processing with the insurance provider.

Bicycle Rental

The client assumes full responsibility for the bicycle and equipment during the rental period. Bicycles are maintained on a daily basis. Clients are responsible for checking the bicycle at the meeting point before the start of the tour and should inform the staff present of any mechanical issues or faults identified prior to departure. The client is responsible for any damage, theft, or loss. If damages exceed the deposit amount, the client agrees to pay the difference.

Tours with Rented Bicycles

The client is responsible for any damage resulting from falls, improper use, or technical maneuvers/jumps.

Limitation of Liability

MadBike shall not be held liable for personal injury, property damage, loss, theft, delays, cancellations, or inconveniences. This includes situations resulting from equipment failure, third-party actions, or circumstances beyond the company's control.

Liability Waiver

The client declares full awareness of the risks involved, assumes total responsibility for their safety, and releases MadBike from any legal liability. This waiver also applies to family members and minors under their responsibility.

Minors

Participation of individuals under 16 years of age requires explicit authorization from a parent or legal guardian and the signing of the corresponding liability waiver.

Applicable Law

These Terms and Conditions are governed by Portuguese law. In the event of a dispute, the Judicial Court of the Funchal District shall have jurisdiction, with express waiver of any other.

Final Provisions

MadBike reserves the right to amend or update these Terms and Conditions at any time without prior notice. It is the client's responsibility to review and remain informed of any changes.
